Ceza mahkemesinde yargılanan;

03.06.2010 tarihinde yapılan
duruşmada tanıklar dinlendi.
Duruşma sonunda dosyanın,
sanıklarla LaserPress arasındaki ilişkinin niteliği ve
iddiaya konu alışverişlerde tahsil edilen şirket
muhasebesine intikal ettirilmeyen para miktarını belirtir
bir rapor hazırlamak üzere bilirkişiye tevdisine bir sonraki
duruşmanın 07.10.2010 tarihine ertelenmesine karar
verilmiştir.
Öte yandan İsviçre Bern şehri
Yüksek Ticaret Mahkemesinde LaserPress tarafından açılan
haksız fesih ve haksız rekabet davasında 07.07.2010
tarihinde duruşma gerçekleşti.
Duruşmaya Bystronic Laser AG adına Ferdi Töngi-CEO ve Johann
Ifanger-Satış Direktörü bizzat katıldılar. Duruşmada
LaserPress Genel Müdürü Numan Akyılmaz ve Gen. Müd. Yard.
Şeniz Akyılmaz taraf olarak ifade verdiler.
Önümüzdeki günlerde yeni bir
duruşma yapılarak Ferdi Töngi ve Johann Ifanger’inde taraf
olarak ifade vermesi bekleniyor.
Tekrar hatırlatmak isteriz.
Bystronic 17.08.2007 tarihinde yukarıda adı geçen
sanıkların işlemiş olduğu suçları şirketimize mal ederek ve
bunları neden göstererek Distribütörlüğümüzü tek taraflı ve
hukuka aykırı olarak iptal etmiştir. Ancak ilginç ve dikkat
çekici olan husus şudur ki, bu eylemleri bahane göstererek
sözleşmemizi fesheden şirket bu olaylar nedeniyle haklarında
ASLİYE CEZA MAHKEMESİNDE dava açılmış bulunan Bülent
Kahraman ve Tamer Gür isimli sanıklarında aralarında
bulunduğu birçok çalışanımızı kendi kadrosuna katarak
Bystronic Türkiye Ofisini açmıştır.
Başlangıçta hakkımızda aslı
olmayan dedikodular yayan BYSTRONIC ‘IN SANIK MÜDÜRLERİNİN
ve Medeniyetin beşiği olarak bilinen İsviçre menşeli bu
firmanın söylemlerine rağmen, Temiz bir toplum ve temiz
bir sac işleme sektörü için yapmış olduğumuz çağrıya
cevap vererek bize yardımda bulunan tüm kişi ve kurumlara
teşekkür ederiz.
Artık sonuna geldiğimize
inandığımız SANIK BÜLENT KAHRAMAN ve SANIK TAMER GÜR
yargılanma sürecinde ve BYSTRONIC hakkında İSVİÇRE Bern
şehrinde devam eden ticaret mahkemesindeki gelişmeleri

Since
20.11.2008, standing trial at Beykoz 2nd Criminal Court of
First Instance by charge of breach of trust;

The
witnesses have been heard on 03.06.2010 during the trial.
It has
been decreed that to entrust the file to an expert for
preparing a report determining money amount collected for
relative dealings but not devolved to the company account
department at the end of the trial and to adjourn the
next trial to 07.10.2010.
On the
other hand, a trial has been realized on 07.07.2010 about
injustice termination and unfair competition opened by
LaserPress at Supreme Commercial Court in Bern City of
Switzerland.
Ferdi
Töngi-CEO and Johann Ifanger-Sales Director on behalf of
Bystronic Laser AG attended to the case personally. Numan
Akyılmaz, President & CEO and Şeniz Akyılmaz, Vice President
& CFO of LaserPress gave statements as party during the
trial.
In the forthcoming days, it is expected that a new trial
would be made and Ferdi Töngi and Johann Ifanger would give
their statements as party.
We would like to remind again that Bystronic had cancelled
our distributorship as unilateral and unlawful on 17.08.2007
attributing crimes of accused persons above-mentioned to our
company and showing reason them. However, an interesting and
remarkable matter is that this company terminated our
contract alleging these acts had opened Bystronic Turkey
Office employing our many employees including Bülent
Kahraman and Tamer Gür opened a case at THE CRIMINAL COURT
OF FIRST INSTANCE because of these events.
We thank
to all persons and corporations who helped us replying our
call for a decent society and a clear sheet metal sector, in
spite of statements of ACCUSED MANAGERS OF BYSTRONIC
spreading unfounded rumours about us though this firm is
supposed to belong to cradle of civilization of Europe.
We will continue to share progresses at the commercial court
continuing in Bern city of SWITZERLAND during justification
process of ACCUSED BÜLENT KAHRAMAN and ACCUSED TAMER GÜR and
about BYSTRONIC, we believe that we have come to an end.
We
invite everyone to follow this case closely for a decent
society and a clear metal sheet metal sector.
